Introduction and Acceptance of Terms

Welcome to Gallenson’s Gun Shop (“Gallenson’s,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and services, including but not limited to the sale of firearms, ammunition, and related accessories, as well as any in-store or online activities at Gallenson’s Gun Shop, located in Salt Lake City, Utah.
By accessing our website or purchasing products from us, you agree to the following terms and conditions. If you do not agree, please do not use our website or services.

Eligibility to Purchase Firearms and Ammunition

By purchasing firearms, ammunition, or other regulated items from Gallenson’s, you confirm that:

• You are of legal age to purchase such products (21 for handguns, 18 for rifles/shotguns) under federal law and the laws of Utah.
• You comply with all applicable federal, state, and local laws governing the purchase, possession, and use of firearms, including passing any required background check.
• You are not prohibited by law from owning or possessing a firearm.
• You are purchasing the firearms, ammunition, or other regulated items for yourself and not for another person.
• All online sales of firearms require transfer to a Federal Firearms Licensee (“FFL”) in your state of residence. This will include completion of ATF Form 4473 and a background check by your local FFL. All NFA Rules apply.
• All firearms and ammunition purchases require presentation of any valid forms of identification required in your state of purchase.
• All ammunition sales are final, and firearm sales are subject to our Return Policy.

Note: We reserve the right to refuse the sale of firearms or ammunition to anyone for any reason, as permitted by law.

Website Use and Product Sales

Accuracy of Information

You agree to provide accurate and up-to-date information when using our website, including when purchasing products. You are responsible for maintaining the accuracy of your account information, including shipping and payment details.

Product Descriptions and Pricing

While we strive to provide accurate product descriptions and pricing, mistakes can occur. Gallenson’s reserves the right to correct any pricing or product description errors at any time, without notice, and to cancel any orders affected by these errors. If Gallenson’s cancels an order or part of an order, Gallenson’s will provide a refund for the amount of the order or the part of the order that was canceled. Gallenson’s does not honor price change requests. Gallenson’s also does not permit “raincheck” pricing for any prior “Sale” or “Daily Deal” prices if you have not placed an order at the time of the “Sale” or “Daily Deal” listing.

Orders and Payment

All orders are subject to acceptance by Gallenson’s. We reserve the right to cancel any order at any time for reasons including suspected fraud, legal violations, or errors in product listings. Payment must be made using accepted methods at the time of order placement, and all payments are processed immediately. It is the customer’s responsibility to be aware of and comply with all applicable federal, state, and local laws regarding the sale, transfer, possession, transportation, or use of firearms, magazines, and ammunition in their locality. Gallenson’s reserves the right to dispute any bank or credit card chargebacks and to refuse all future orders placed by any customer who cancels an order via debit or credit card chargeback following shipment.

Indemnification

You agree to defend, indemnify, and hold Gallenson’s harmless from and against any and all claims, damages, costs, and expenses, including attorney’s fees, arising from or related to your breach of this Agreement or the use of the Site, or any materials, products, or services available at this Site, by you or someone acting under your control. This obligation expressly includes defense and indemnity involving claims of independent negligence by Gallenson’s.

Limitation of Liability

Gallenson’s shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website, products, or services. This includes, but is not limited to, damages resulting from the use or misuse of firearms or ammunition purchased from us. Gallenson’s disclaims all liability for any such damages.

Intellectual Property

All content on our website, including but not limited to text, images, logos, product descriptions, and software, is the exclusive property of Gallenson’s or its content suppliers and is protected by applicable intellectual property laws. Unauthorized use, reproduction, or distribution of any content is strictly prohibited without the express written consent of Gallenson’s.

Legal Compliance and Prohibited Uses

You agree to comply with all applicable laws when using our website or purchasing products from us. You agree not to:

• Violate any federal, state, or local firearm regulations.
• Provide false or misleading information.
• Attempt to circumvent legal requirements, such as background checks.

You alone are responsible for knowing or learning and complying with all applicable laws, rules, and restrictions with respect to firearms where you reside and/or plan on storing your firearms. Any misuse of our services may result in the termination of your account and notification to the relevant authorities.

Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the state of Utah, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved exclusively in the state or federal courts located in Salt Lake City, Utah. By placing an online order with Gallenson’s, the customer submits to the exclusive jurisdiction of the federal or state courts in Salt Lake County, Utah, for any litigation, action, or proceeding related to the order or these Terms and Conditions. The customer knowingly, voluntarily, and irrevocably consents to the personal jurisdiction and venue of these courts and waives any right to dismiss or transfer based on improper venue or forum non conveniens.

Severability

If any provision of these Terms and Conditions shall to any extent be held invalid or unenforceable by a court of competent jurisdiction, then:

• The remainder of the Terms and Conditions shall not be affected, and every remaining provision of the Terms and Conditions shall be valid and binding to the fullest extent permitted by law.
• A suitable and equitable provision shall be substituted for such invalid and unenforceable provision in order to carry out, so far as may be valid and enforceable, the intent and purpose of such invalid or unenforceable provision.

Destination Control Statement

These items are controlled by the U.S. Government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end-user(s) herein identified. They may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized ultimate consignee or end-user(s), either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. Government or as otherwise authorized by U.S. law and regulations.

Changes to Terms of Service

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website with the effective date. Continued use of our services after changes are made constitutes acceptance of the revised Terms.
